1. Acceptance of Terms

By accessing or using the Seren application ("App") provided by Juan Vizoso ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Seren is an AI-powered journaling application designed to help you reflect, grow, and gain insights from your personal thoughts and experiences. The App provides features including but not limited to:

  • Personal journaling with AI-assisted prompts
  • Self-discovery analysis and insights
  • Weekly reports and progress tracking
  • Voice-to-text dictation
  • Secure cloud storage and synchronization

3. Use of the Service

You agree to use the App only for purposes permitted by these Terms of Service and any applicable laws, regulations, or generally accepted practices in the relevant jurisdictions. You must not:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the App
  • Interfere with or disrupt the App's functionality
  • Use the App to transmit harmful, offensive, or inappropriate content
  • Reverse engineer, decompile, or disassemble any part of the App

4. User Accounts

To use certain features of the App, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if you violate these Terms.

5. User Content

Ownership: You retain full ownership of all journal entries and personal content you create within the App ("User Content"). We do not claim any ownership rights over your User Content.

License: By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing and improving the App's services to you. We will not use, host, reproduce, modify, create derivative works, communicate, publish, or distribute your User Content for any other purposes without your explicit consent.

AI Processing: Your journal entries may be processed by AI systems to provide personalized prompts, insights, and analysis. This processing is done to enhance your journaling experience and is subject to our Privacy Policy.

6. Subscription Services

6.1 Billing and Renewal

If you purchase a subscription, you agree to pay the applicable fees. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. Payment will be charged to your Apple ID account or other designated payment method.

6.2 Cancellation

You may cancel your subscription at any time through your Apple ID account settings or the App. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of your paid period.

6.3 Refunds

Subscription fees are generally non-refundable. However, refund requests may be considered on a case-by-case basis at our sole discretion. For App Store purchases, refunds are handled by Apple according to their refund policies.

6.4 Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated to you in advance and will apply to subsequent billing cycles.

6.5 Free Trials

If offered, free trials provide temporary access to premium features. Unless cancelled before the trial ends, your subscription will automatically convert to a paid subscription.

7. Intellectual Property

The App, including its design, features, code, graphics, and AI systems, is owned by Juan Vizoso and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our written permission.

8. Third-Party Services

The App may integrate with third-party services including:

  • Apple (authentication, payments, App Store)
  • Google (authentication)
  • Cloud infrastructure providers
  • AI processing services

Your use of these third-party services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The App is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions you may have regarding a medical condition or mental health concerns.

We do not guarantee that:

  • The App will be uninterrupted, secure, or error-free
  • Results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUAN VIZOSO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

  • Your access to or use of (or inability to use) the App
  • Any conduct or content of any third party on the App
  • Any content obtained from the App
  • Unauthorized access, use, or alteration of your content

Our total liability for any claims arising from or relating to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Juan Vizoso and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Modification and Termination of Services

We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time
  • Add or remove features or functionality
  • Terminate your access to the App for any reason

We will make reasonable efforts to notify you of significant changes to the App.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within the App or by other appropriate means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Germany, and German law shall apply.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Juan Vizoso regarding your use of the App.
